Thompson ORDINANCE NO. 9466 AN ORDINANCE CLOSING AND ABANDONING A PORTION OF HARBIN LANE LOCATED NORTHWEST FROM TANGLEWOOD ROAD, SOUTHWEST OF HAYWOOD AVENUE, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned a portion of Harbin Lane located northwest from Tanglewood Road, southwest of Haywood Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Harbin Lane, a 60 foot wide unopened right-of-way beginning on the northwest line of Tanglewood Road 150 feet southwest of the intersection of the northwest line of Tanglewood Road with the southwest line of Haywood Avenue, and extending northwest 150 feet between parallel lines to the northwest line (if extended) of lot 79, Chattanooga Estates Company's Map of Lots 61A and 62A, a Partition of Lot 61 and the North Half of Lot 62, and Lots 78 and 79, Haywood Heights, as shown by plat of record in plat book 17, page 30, R.O.H.C. Said street separates lot 79, said Chattanooga Estates Company's subdivision from lot 55 and part of lot 56, Revised Map of Part of Haywood Heights, as shown by plat of record in plat book 14, page 29, R.O.H.C. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The reservation for South Central Bell of a utility easement the width of said right-of-way for the purpose of maintaining its facilities within said right-of-way. 3. The areas reserved for the above easements shall be kept free and clear of all structures. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
